The Supreme Court on Monday has upheld the victory of the Kogi APC candidate Yahaya Bello as the governor of Kogi State having won the November 16 Kogi election. The ruling came just now as the court dismissed the petition of Musa Wada of the Peoples Democratic Party, PDP
Justice Uwani Musa Abba Aji, who delivered the judgement on behalf of the seven-man panel of the court led by Chief Justice of Nigeria, Mohammed Tanko said the appeal by the PDP has no merit and therefore unanimously dismissed.
The panel said the petitioners did not prove beyond reasonable doubts that the results from the election were not a reflection of the votes cast could not also prove that Yahaya Bello did not win majority votes.
The judgement is also hinged on the fact that PDP did not prove that electoral malpractices marred the exercise as they could did not call polling unit agents as witnesses.
And the petitioner could only prove over-voting in 24 out of 729 polling units which is not significant enough to have voided the victory of the APC candidate.
